Any vehicle or vehicles registered to an owner(s) who has accumulated five or more unpaid tickets that have reached the stage of the Notice of Final Determination are subject to immobilization.

A wheel restraint (Boot) will be placed on any vehicle registered to the owner when the vehicle is located upon a public way, public property, or private property with consent of the property owners.

All immobilization related correspondence, appearances, and fees are to be paid at the Skokie Police Department.

Immobilization Process

  The registered owner(s) of the vehicle(s) will be subject to the following process:

1. A notice of impending immobilization will be mailed to the registered owner(s) by first class mail to the address of record according to the Illinois Secretary of State's registry (or state other than Illinois as applicable). Any vehicle registered to the owner is subject to immobilization.
2. The registered owner(s) has 30 days from the date of the notice to pay all listed tickets on the notice in full. Partial payment of the listed tickets will not relieve the owner of immobilization eligibility.
3. The registered owner(s) also has 30 days from the date of the notice to file a written demand for a pre-immobilization hearing with the Skokie Police Department. The Hearing will take place within seven business days of the written Hearing request or a mutually agreed upon date.
4. All payments and written demands for a hearing should be submitted to the Village of Skokie Police Department.

Tampering with an immobilization device is a violation of the Village code. Any person causing damage to or destruction of an immobilization device will be required to pay all repair or full replacement costs in addition to a maximum fine.

Pre-Immobilization Hearing

The Hearing is solely for the purpose allowing the registered owner(s) to submit evidence that he/she is not liable for the tickets listed in the notice for one of the following reasons:

1. The registered owner(s) can provide evidence that he/she was not the owner(s) or lessee(s) of the vehicle on the date or dates that the tickets were issued.
2. The registered owner(s) can provide evidence that all tickets listed on the notice are paid in full.
3. Partial payment of the unpaid tickets on the notice of impending mobilization listing will not impact the enforcement of the immobilization order on the remaining tickets regardless of the remaining number of tickets unpaid.
4. The registered owner can provide evidence that a number of unpaid tickets were improperly included on the Notice of Impending Immobilization and that number reduced the unpaid tickets to a number below 5 unpaid tickets, the vehicle will be removed from eligibility for immobilization.

Post-Immobilization

A Notice of Immobilization will be affixed to the vehicle at the time the restraint device, Boot, is attached to the wheel. This notice will provide information regarding the procedure to have the device removed.

The owner will be required to follow the procedures listed within 72 hours of the immobilization:

1. Pay the immobilization fee of $75 and all resulting towing and storage charges.
2. Pay the entire amount of the tickets listed on the Notice of Impending Immobilization and pay in full all unpaid Notices of Final Determinations arising after to the issuance of the impending immobilization notice. The owner may also file a written demand with the Skokie Police Department for a post-immobilization hearing within 7 days of the immobilization and post a deposit bond of 110% of the total amount owed as listed on the Notice. All payments and bonds must be in the form of cash, money order, or certified check payable to the Village of Skokie.

Failure to Respond

Failure to respond within 72 hours of the immobilization may result in the vehicle being towed and impounded. Failure to request a hearing within seven days of the immobilization will be deemed a waiver of the right to a hearing.

Post-Immobilization Hearing

The post immobilization hearing will take place within 48 hours of the receipt of the request or a mutually agreed upon date.

• Failure to appear at the hearing will result in the forfeiture of the bond to the Village of Skokie.
• If the owner presents evidence at the hearing that a number of tickets were improperly included in the Notice of Impending Immobilization and the result reduces the unpaid tickets below 5 then the owner's vehicle will be released without cost to the owner.
• Partial payment of the unpaid tickets on the notice of impending mobilization listing will not impact the enforcement of the immobilization order on the remaining tickets regardless of the remaining number of tickets unpaid.
